However, as currently drafted, these regs bring rescues that use foster homes into the definition of kennel and subjects the foster homes to inspection, and put the foster homes and the rescues that they volunteer with on the same category as puppymills. And the regs also make it illegal for a rescue to accept a dog from a rescue that is not licensed in PA or from a mill that is in violation of the regs (so we will only be able to rescue dogs from NICE mills not from the BAD mills). It also requires that any dog brought into PA have a health certificate. The Dept of Agriculture has exceeded the authority granted to it in the PA Dog Laws by the legislature in drafting these regs so as to have them apply to rescues. Oh and out of state rescues that adopt more than 26 dogs in any calendar year (it does not say 26 in PA) fall into the Out Of State Dealer Category instead of the Nonprofit Kennel category and would have to pay $300 for the priviledge! Not to mention that the regs as drafted require foster homes to keep a log of the date and time when dogs go in, and dogs come out of the house. Its application to foster homes is absolutely ridiculous. Whoever wrote this at the PA DOA is extremely rescue unfriendly to say the least.
